Welcome to Adivasi Music ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Adivasi Music website, mobile application, and related services (collectively, the "Platform").

By downloading, accessing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Platform.

1. About Adivasi Music

Adivasi Music is a premier digital music streaming and distribution platform dedicated to Adivasi Music, Tribal Songs, Folk Music, Regional Music, and Independent Artists. The Platform facilitates music streaming, artist profiles, music discovery, content publishing, and artist monetization services.

2. Eligibility & Account Registration

2.1 Age Requirement

You must be at least 18 years old to create an account. If you are under 18, you may only use the Platform with the verifiable consent and supervision of a parent or legal guardian.

2.2 Account Security

You agree to provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.3 Unauthorized Access

You must immediately notify us at support@adivasimusic.com of any unauthorized use or suspected security breach of your account.

3. User & Creator Content

Adivasi Music hosts both users (listeners) and creators (artists/publishers).

3.1 For Users (Streaming)

We grant you a limited, non-exclusive, non-transferable, and revocable license to make personal, non-commercial use of the Platform and its audio content.

3.2 For Creators (Uploading)

By uploading, publishing, or distributing music, cover art, or any other content ("Creator Content") on our Platform, you represent and warrant that:

You own the intellectual property rights or possess the necessary licenses, rights, and permissions to distribute the content.
Your content does not infringe upon the copyrights, trademarks, or privacy rights of any third party.
You grant Adivasi Music a worldwide, royalty-free, non-exclusive license to host, reproduce, distribute, stream, publicly perform, and promote your content across the Platform and our marketing channels.

4. Copyright Infringement & Takedown Policy

We respect intellectual property rights and comply with the Indian Copyright Act, 1957, and standard digital copyright laws (such as DMCA).

If you believe that your copyrighted work has been uploaded or used on Adivasi Music without authorization, please submit a formal copyright infringement claim to our Grievance Officer at copyright@adivasimusic.com.

Repeat Infringers: We maintain a strict policy of terminating the accounts of creators or users who are repeat copyright infringers.

5. Prohibited Activities

To ensure a safe and legal environment, you agree NOT to:

Upload pirated, unauthorized, or unlicensed music.
Use automated systems, bots, or scripts to artificially inflate stream counts, views, followers, or engagement.
Reverse-engineer, decompile, or hack the Adivasi Music application or website.
Scrape, extract, or download audio files for offline distribution outside of the Platform's built-in offline features.
Distribute malware, viruses, or any malicious code.
Impersonate any artist, user, label, or entity.
Upload content that promotes hate speech, violence, illegal activities, or explicit material.

6. Subscriptions, Payments & Monetization

6.1 Premium Services

Adivasi Music may offer premium ad-free streaming, high-quality audio, or offline downloads for a fee. Prices and subscription terms will be disclosed before purchase.

6.2 App Store Billing

If you purchase a subscription via the Google Play Store or Apple App Store, your payment is processed by them and is subject to their respective terms and auto-renewal policies.

6.3 Refunds

All digital purchases and subscriptions are final and non-refundable, except where mandated by applicable law.

6.4 Artist Royalties

If applicable, monetization and royalty payouts to creators will be governed by a separate Artist Distribution Agreement.

7. Intellectual Property of Adivasi Music

The Adivasi Music brand, logos, app design, source code, and underlying technology are the exclusive property of Adivasi Music. You may not copy, reproduce, or commercially exploit our platform's UI/UX or branding without prior written consent.

8. Third-Party Services & Advertising

Our Platform may display advertisements or contain links to third-party websites, ad networks, and payment gateways. We do not endorse these third parties and are not responsible for their content, privacy practices, or terms.

9. Disclaimer of Warranties

DISCLAIMER: THE PLATFORM AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ADIVASI MUSIC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE BUG-FREE, UNINTERRUPTED, OR FREE FROM UNAUTHORIZED CONTENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADIVASI MUSIC AND ITS FOUNDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, OR DATA RESULTING FROM (A) YOUR USE OF THE PLATFORM, (B) UNAUTHORIZED ACCESS TO SERVERS, OR (C) THIRD-PARTY CONDUCT OR CONTENT.

11. Indemnification

You agree to indemnify, defend, and hold harmless Adivasi Music, its affiliates, and employees from any claims, damages, legal fees, or liabilities arising from your violation of these Terms, your infringement of any third-party rights, or your uploaded content.

12. App Store Constraints

If you download the app from Google Play or the Apple App Store, you acknowledge that these Terms are between you and Adivasi Music, not with the app store providers. The app store providers are not responsible for providing maintenance or support for Adivasi Music.

13. Suspension & Termination

We reserve the right to suspend, restrict, or terminate your account and access to the Platform at any time, without notice or liability, if we suspect a violation of these Terms, illegal activities, or fraudulent behavior.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts located in Ranchi, Jharkhand, India.
